Fair Debt Collection Practices Act

The Fair Debt Collection Practices Act (FDCPA) is a federal law that limits the behavior and actions of third-party debt collectors who are attempting to collect debts on behalf of another person or entity. Silver 7 Holdings strictly adheres to all provisions of the FDCPA.

Your Rights Under the FDCPA

Right to Validation

Within 5 days of initial contact, we must send you a written notice containing the amount of the debt, the name of the creditor, and a statement of your right to dispute the debt.

Right to Dispute

You have 30 days from receiving the initial notice to dispute the debt in writing. Upon receiving your dispute, we must cease collection activity until we provide verification of the debt.

Right to Request Cease Communication

You may request in writing that we stop contacting you. After receiving such a request, we may only contact you to confirm we will stop communication or to notify you of specific legal actions.

Protection from Harassment

Debt collectors cannot harass, oppress, or abuse you. This includes threats of violence, use of obscene language, repeated phone calls intended to annoy, or publishing your name on a 'bad debt' list.

Protection from False Statements

Debt collectors cannot use false, deceptive, or misleading representations. This includes misrepresenting the amount owed, falsely claiming to be an attorney, or threatening actions that cannot legally be taken.

Protection from Unfair Practices

Debt collectors cannot use unfair or unconscionable means to collect a debt, such as collecting amounts not authorized by the agreement, depositing post-dated checks early, or contacting you at unreasonable times.

How to Dispute a Debt

If you believe a debt is not yours or the amount is incorrect, you have the right to dispute it. Here's how:
